Welcome to CV INSAN DINAMIS KREATIF ("Indikrea", "Company", "we", "us", or "our"). By accessing our website (indikrea.id), engaging our creative services, submitting project orders, or registering manuscripts, you ("Client", "User", or "you") agree to be legally bound by these Terms of Service and Refund Policy in full.
1. Legal Entity & Authorized Service Scope
CV INSAN DINAMIS KREATIF is an officially registered corporate partnership operating under valid Indonesian Standard Industrial Classifications (KBLI):
Digital Creation (KBLI 62013, 74130, 18202): Custom website development, web applications, cinematic video editing, brand identity systems, and 3D modeling/prototyping.
Social Media Management (KBLI 73100, 74201): Social media content creation, commercial photography/videography, performance ads optimization (Meta & TikTok Ads), and creator endorsements.
Book Publishing (KBLI 46422, 18111): Manuscript editing, standard book layouting, cover design, official ISBN & Barcode registration with the National Library of Indonesia (Perpusnas), and physical book printing (IndiKrea Press).
2. Client Warranties & Content Indemnification
The Client represents and warrants that all raw materials, assets, text, media, trademarks, and book manuscripts provided to Indikrea are original, owned by the Client, or properly licensed. The Client shall defend, indemnify, and hold harmless CV INSAN DINAMIS KREATIF, its directors, employees, and contractors from any third-party claims, liabilities, damages, or legal costs arising from intellectual property infringements, plagiarism, defamation, or regulatory violations contained within Client-supplied materials.
3. Payment Terms & Security
All commercial transactions are processed in Indonesian Rupiah (IDR) through our licensed payment gateway partner, Midtrans.
Unless agreed otherwise in writing, project initiation requires a minimum commitment deposit of 50% (DP) of the total project value.
Final deliverables, master vector files, administrative source codes, live hosting deployments, and physical book dispatches will be executed only upon receipt of 100% full balance payment.
4. Strict Refund & Cancellation Policy
Due to the bespoke nature of creative labor, technical engineering, and formal government licensing (ISBN), our refund policy is strictly defined as follows:
Uncommenced Projects (Full Refund Window): A 100% refund (less non-refundable payment gateway processing fees, if applicable) may be granted only if a written cancellation request is submitted within 24 hours of transaction completion, provided that our team has not yet commenced initial brief analysis, research, or creative drafting.
Projects in Progress (Strictly Non-Refundable): Once creative work, wireframing, coding, video cutting, social media planning, or manuscript layouting has begun, the initial 50% deposit is STRICTLY NON-REFUNDABLE. This deposit constitutes liquidated damages to cover operational time, specialist allocation, and proprietary work expended.
ISBN Government Rejection (Publishing Only): In the unlikely event that an ISBN application is formally rejected by the National Library (Perpusnas) due to administrative faults solely attributable to Indikrea that cannot be rectified, Indikrea will refund 100% of the ISBN administration fee component.
Refund Claim Procedure: All refund requests must be formally submitted via email to indikrea@gmail.com with the official Midtrans receipt. Approved refunds will be disbursed within a maximum of 14 business days following written authorization by the Director of CV INSAN DINAMIS KREATIF.
Revisions are strictly limited to the quantities specified in each purchased package tier. Requests for features, pages, or concepts exceeding the agreed brief will be quoted separately as out-of-scope work. If a Client fails to provide feedback, materials, or approvals for more than 14 consecutive calendar days, Indikrea reserves the right to declare the current milestone accepted and invoice for completed work.
6. Intellectual Property Rights & Portfolio Rights
Full copyright ownership or commercial usage rights for customized final deliverables shall transfer to the Client strictly upon receipt of 100% full payment settlement. Indikrea retains the perpetual, royalty-free right to display non-confidential finished deliverables, website snapshots, and published book covers within its professional portfolios, case studies, and promotional showcases.
7. Limitation of Liability
In no event shall CV INSAN DINAMIS KREATIF, its officers, or affiliates be liable for any indirect, incidental, punitive, or consequential damages, including loss of business profits, data loss, social media account restrictions, or advertising performance fluctuations resulting from third-party algorithmic changes. Indikrea's total cumulative liability for any claim arising out of these Terms shall not exceed the total fees actually paid by the Client for the specific service in dispute.
8. Governing Law & Dispute Resolution
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the Republic of Indonesia. Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved amicably through mutual consultation; failing which, the dispute shall be submitted to the exclusive jurisdiction of the District Court of South Jakarta (Pengadilan Negeri Jakarta Selatan).
